Use of the Service The Service is provided to allow you to backup and store your photos online. You are solely responsible for the content that you upload to the Service, and for ensuring that you have the necessary rights to use and upload that content.
Ownership and License You retain ownership of all photos and other content that you upload to the Service. By using the Service, you grant CheckM8 a non-exclusive, royalty-free license to use, modify, and display your content solely for the purpose of providing the Service to you.
Limitation of Liability CheckM8 provides the Service on an "as is" basis, and makes no warranties or representations of any kind, either express or implied, with respect to the Service. This includes, but is not limited to, warranties of merchantability or fitness for a particular purpose.
In no event shall CheckM8 be liable to you or any third party for any direct, indirect, incidental, special, or consequential damages arising out of or in connection with your use of the Service or the loss of your photos. You agree to indemnify and hold harmless CheckM8 from any and all claims, damages, and expenses (including attorneys' fees) arising out of or in connection with your use of the Service.
Termination of Service CheckM8 reserves the right to terminate the Service at any time, for any reason, without prior notice to you. In the event of such termination, CheckM8 shall have no liability to you or any third party for the loss of your photos.
Changes to the Terms of Use CheckM8 may update or modify these terms of use at any time, without prior notice to you. Your continued use of the Service after any such changes will constitute your acceptance of the new terms.
Governing Law These terms of use shall be governed by and construed in accordance with the laws of the EU, without regard to its conflict of law provisions.
